2. Service Description

Notiscale is an AI-first CRM that lets creator agencies and individual creators connect multiple fansites (e.g., OnlyFans, MYM, Uncove, Fanvue and others), manage chatting operations, invite team members (“chatters”), assign them to specific conversations without sharing platform credentials, and optionally automate tasks with AI.

The service is available globally, except where restricted by applicable law. Users are responsible for ensuring their use complies with laws and with the terms of the third-party platforms they connect.

For certain platforms (e.g., OnlyFans, MYM), we request explicit access from the creator to connect their account. Other platforms (e.g., Fanvue, Uncove) may use different integration methods; connection flows are disclosed in-product.

3. Eligibility & Accounts

• Service intended for users aged 18+ only. We rely on connected platforms to verify age where applicable.
• Roles include: Admin (owner), Manager (all except billing & subscriptions), and Chatter (assigned chats only).
• You must provide accurate registration information and keep credentials secure.

4. Acceptable Use & Third-Party Platforms

• You will comply with all applicable laws and with each connected platform’s terms.
• Do not misuse the service (e.g., spamming, scraping, reverse engineering, harmful content).
• You authorize Notiscale to access and process data from connected platforms (metrics, chat metadata, analytics) solely to provide the service.
• You are solely responsible for compliance with all applicable platform rules, policies, terms of service, creator obligations, age-verification requirements, and disclosure requirements (including any obligations applicable to AI-assisted communications).

5. Subscriptions, Pricing & Trials

• Pricing is per creator. Creators earning < $10k/mo are billed $30/creator/month; creators ≥ $10k/mo are billed $150/creator/month.
• AI Suite add-on: $70/creator/month. If Autonomous AI chatter is activated, Notiscale charges an additional 10% commission on net AI-attributed sales.
• 14-day free trial for the CRM may be offered; no refunds after billing starts.
• Prices and taxes are disclosed at checkout and may change with notice.

6. Intellectual Property

Users retain ownership of their content, scripts, and media. You grant Notiscale a limited worldwide license to host, process, and display such content solely to operate and improve the service. The Notiscale platform, brand, code and materials are owned by Notiscale and protected by law.

7. Privacy & Data

Our Privacy Policy explains what data we collect, how we use it, and your GDPR rights. At signup, we collect account data (agency vs individual, agency name, email, password). During use, we process chat activity (including processed chats and previews/metadata), performance signals (who sent which message and when), and, if enabled, historical data for analytics. We do not sell personal data or share it with third parties beyond essential processors. Cross-border transfers may occur to deliver the service.

By creating an account, you agree to these Terms, the Privacy Policy and our Data Processing Agreement, each incorporated herein by reference. For most processing of fan data, the customer (creator or agency) acts as the data controller and Notiscale acts as the processor. 8. AI Features & Customer Responsibility

• You acknowledge that certain features of the Services use artificial intelligence and automated systems to generate, recommend, prioritize, or send communications.
• Outputs can be imperfect or require human review. You remain solely responsible for all communications sent through the Services, whether generated by a human user, an AI system, or a combination thereof.
• You are solely responsible for any disclosure obligations applicable to your use of AI-assisted or automated communications, including where required by platform rules or applicable law (such as EU AI Act transparency obligations).
• You warrant that you have all rights and permissions necessary to provide data to Notiscale and to use AI-generated communications through the Services.

9. Termination

• You can cancel at any time from your account. We may suspend or terminate for non-payment, violations of these Terms, or third-party platform policies.
• Upon termination, your account is closed and data is deleted per our retention policy.

10. Disclaimers & Liability

THE SERVICE IS PROVIDED “AS IS”. To the maximum extent permitted by law, Notiscale disclaims all warranties and limits liability for indirect, incidental, consequential, or special damages. Our aggregate liability is limited to fees paid in the 12 months preceding the claim.

11. Governing Law & Jurisdiction

These Terms are governed by French law. Exclusive jurisdiction lies with the courts of Paris, France.

12. Changes to these Terms

We may update these Terms. Material changes will be notified in-app or by email. Your continued use after the effective date constitutes acceptance.
