2. Service Description

Notiscale is an AI-first CRM that lets creator agencies and individual creators connect multiple fansites (e.g., OnlyFans, MYM, Uncove, Fanvue and others), manage chatting operations, invite team members (“chatters”), assign them to specific conversations without sharing platform credentials, and optionally automate tasks with AI.

The service is available globally, except where restricted by applicable law. Users are responsible for ensuring their use complies with laws and with the terms of the third-party platforms they connect.

For certain platforms (e.g., OnlyFans, MYM), we request explicit access from the creator to connect their account. Other platforms (e.g., Fanvue, Uncove) may use different integration methods; connection flows are disclosed in-product.

3. Eligibility & Accounts

• Service intended for users aged 18+ only. We rely on connected platforms to verify age where applicable.
• Roles include: Admin (owner), Manager (all except billing & subscriptions), and Chatter (assigned chats only).
• You must provide accurate registration information and keep credentials secure.

4. Acceptable Use & Third-Party Platforms

• You will comply with all applicable laws and with each connected platform’s terms.
• Do not misuse the service (e.g., spamming, scraping, reverse engineering, harmful content).
• You authorize Notiscale to access and process data from connected platforms (metrics, chat metadata, analytics) solely to provide the service.
• You are solely responsible for compliance with all applicable platform rules, policies, terms of service, creator obligations, age-verification requirements, and disclosure requirements (including any obligations applicable to AI-assisted communications).

5. Subscriptions, Pricing & Trials

• Pricing is per creator. Creators earning < $10k/mo are billed $30/creator/month; creators ≥ $10k/mo are billed $150/creator/month.
• AI Suite add-on: $70/creator/month. If Autonomous AI chatter is activated, Notiscale charges an additional 10% commission on net AI-attributed sales.
• 14-day free trial and results guarantee. Try Notiscale free for 14 days, with no credit card required. The trial is completely free; the published subscription prices and AI sales commission apply if you choose to continue on a paid plan after the trial.
• Prices and taxes are disclosed at checkout and may change with notice.

6. Intellectual Property

Users retain ownership of their content, scripts, and media. You grant Notiscale a limited worldwide license to host, process, and display such content solely to operate and improve the service. The Notiscale platform, brand, code and materials are owned by Notiscale and protected by law.

7. Privacy & Data

Our Privacy Policy explains what data we collect, how we use it, and your GDPR rights. At signup, we collect account data (agency vs individual, agency name, email, password). During use, we process chat activity (including processed chats and previews/metadata), performance signals (who sent which message and when), and, if enabled, historical data for analytics. We do not sell personal data or share it with third parties beyond essential processors. Cross-border transfers may occur to deliver the service.

By creating an account, you agree to these Terms, the Privacy Policy and our Data Processing Agreement, each incorporated herein by reference. For most processing of fan data, the customer (creator or agency) acts as the data controller and Notiscale acts as the processor. 8. AI Features & Customer Responsibility

• You acknowledge that certain features of the Services use artificial intelligence and automated systems to generate, recommend, prioritize, or send communications.
• Outputs can be imperfect or require human review. You remain solely responsible for all communications sent through the Services, whether generated by a human user, an AI system, or a combination thereof.
• You are responsible for the lawful configuration and use of AI on your accounts, including accurate disclosures and applicable platform rules. These customer responsibilities do not exclude or transfer Notiscale’s own obligations as an AI system provider under applicable law.
• You warrant that you have all rights and permissions necessary to provide data to Notiscale and to use AI-generated communications through the Services.

8.1 AI transparency and fan disclosures

Where applicable law or platform rules require disclosure, fans must be clearly informed that AI is used to generate replies no later than their first interaction with the AI. A disclosure in these Terms alone does not inform your fans.

Profile notices and other disclosure methods

Before enabling autonomous AI, you must put an accurate, prominent AI notice on the relevant creator profile or use another disclosure method that informs the fan by the first AI interaction. A profile notice is suitable only where it is actually presented to the fan before that interaction. It must not be hidden in lengthy terms, behind expandable text, or removed after setup.

Suggested wording, to be adapted accurately to your use:

Chats may include AI-generated replies. A person can review or intervene when needed.

For existing fans or other flows where prior presentation of a profile notice cannot be established, provide a clear notice before the next AI-generated reply. Do not assume that an earlier customer acceptance of our Terms proves that a fan received the disclosure.

Customer responsibilities and verification

• Choose and maintain wording that clearly mentions AI-generated replies and accurately describes human involvement.
• Keep dated evidence of the notice, where it is displayed, and when it was made available. Provide this evidence on request.
• Do not hide, delete or circumvent required disclosures, or use AI to falsely deny AI involvement. Notify us when your disclosure or use changes.
• Cooperate with verification requests and correct missing or inadequate notices promptly. Notiscale may require corrective action or suspend AI messaging where transparency requirements are not met.
• Any exception requires a documented legal basis and written review by Notiscale. Customer preference alone is not an exemption; approved exceptions must be reviewed when circumstances change and at least annually.

Notiscale retains its own applicable provider obligations. Human-readable disclosure and the separate requirements concerning machine-readable marking of AI-generated content are distinct. Internal labels identifying AI messages do not by themselves establish compliance with marking requirements.

9. Termination

• You can cancel at any time from your account. We may suspend or terminate for non-payment, violations of these Terms, or third-party platform policies.
• Upon termination, your account is closed and data is deleted per our retention policy.

10. Disclaimers & Liability

THE SERVICE IS PROVIDED “AS IS”. To the maximum extent permitted by law, Notiscale disclaims all warranties and limits liability for indirect, incidental, consequential, or special damages. Our aggregate liability is limited to fees paid in the 12 months preceding the claim.

11. Governing Law & Jurisdiction

These Terms are governed by French law. Exclusive jurisdiction lies with the courts of Paris, France.

12. Changes to these Terms

We may update these Terms. Material changes will be notified in-app or by email. Your continued use after the effective date constitutes acceptance.
